Effective Date: December 30, 2025
Welcome to MarkMed Inc. (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website (the “Site”), including any content, functionality, and services offered on or through the Site, as well as your purchase of products from us, such as mobility scooters, wheelchairs, and related accessories. By accessing or using the Site, placing an order, or otherwise engaging with our services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.
We are a Florida corporation, and these Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles. You consent to the exclusive jurisdiction and venue of courts in Florida for any disputes arising from or relating to these Terms or your use of the Site.
1. Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices, legal requirements, or services. We will notify you of material changes by posting the updated Terms on the Site and, where feasible, by emailing you at the address associated with your account at least 30 days before the changes take effect. Your continued use of the Site or services after such notice constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
2. Use of the Site and Services
You must be at least 18 years old or the age of majority in your jurisdiction to use the Site or place an order. You agree to use the Site only for lawful purposes and in accordance with these Terms. You may not:
- Use the Site in any way that violates applicable federal, state, or local laws.
- Engage in unauthorized access, interference, or disruption of the Site.
- Transmit viruses, spam, or other harmful material.
- Impersonate others or misrepresent your affiliation.
We reserve the right to terminate or suspend your access to the Site at any time for violations of these Terms, without notice or liability.
Abusive or Excessive Communications
MarkMed Inc. is committed to providing respectful, professional, and efficient customer support. In return, we require that all communications with our employees, agents, and representatives be conducted in a courteous and professional manner.
We therefore reserve the right, in our sole discretion, to block or restrict incoming phone and/or email communications from any customer or prospective customer who:
(a) Uses vulgar, profane, obscene, threatening, harassing, discriminatory, intimidating, or otherwise abusive language or behavior toward our team;
(b) Repeatedly contacts us by phone, email, or other means regarding the same issue after we have provided a substantive response or resolution, or without providing material new information; or
(c) Engages in any pattern of communication that we reasonably determine to be excessive, disruptive, or intended to harass or abuse our support resources or personnel.
If we exercise this right, we will make reasonable efforts to notify you and will require that all further legitimate communications (including warranty claims, formal notices, or account-related inquiries) be submitted in writing by certified U.S. Mail to MarkMed Inc. at the mailing address designated in these Terms or as otherwise provided by us.

3. Product Information and Availability
We strive to provide accurate descriptions, images, and pricing for our products. However, we do not warrant that product descriptions, colors, or other content are error-free, complete, or current. Prices and availability are subject to change without notice. We reserve the right to correct errors, limit quantities, or refuse orders at our discretion, including after an order is placed. If we cannot fulfill an order, we will notify you and provide a full refund.
4. Orders and Payment
By placing an order, you represent that you are authorized to use the payment method provided. We accept major credit cards, PayPal, and other methods as indicated at checkout. Payment is processed at the time of order, and all charges are in U.S. dollars. You are responsible for all applicable taxes, shipping, and handling fees.
We may cancel or refuse orders if we suspect fraud, unauthorized activity, or violations of these Terms. Title and risk of loss pass to you upon delivery to the carrier.
5. Shipping and Delivery
We ship products within the United States. Shipping times are estimates and not guaranteed. Delays may occur due to weather, carrier issues, or other factors beyond our control. We are not liable for any delays or additional costs. For international orders (if available), you are responsible for customs duties, taxes, and compliance with import laws.
Inspection Period for Damage:
Sometimes damage occurs during the shipping process. We allow a THREE (3) Day (from the time of delivery) inspection period to notify us of damage that has occurred during shipping. We feel this is a reasonable timeframe to inspect your new device and notify us of damages.
6. Returns and Refunds
We want you to be satisfied with your purchase. Returns are accepted within 15 days of delivery for most items, subject to the conditions below. All returns must be initiated by completing a return request form on the following page: We require pictures of the device and package to determine if the device will be accepted as a return, or not. We only accept items that have not been used outdoors, have the original packaging that has not been altered and are in new condition for returns. Once your request has been received, we will follow up via email with return instructions, if the device is in returable condition. Please note, we do NOT accept returns from our Dealers. All sales are final to dealers, although all devices do come with a warranty, as stated on the product page.
Eligibility:
- Products must be unused, in original packaging, and in resalable condition (no signs of soiling, wear, damage, or outdoor use).
- Custom, sanitary, or personalized items (e.g., certain cushions or accessories) are non-returnable.
- Mobility devices tested indoors only may be eligible; evidence of outdoor use or use in unclean indoor settings will disqualify the return.
Items Not Eligible for Return:
Please note, the following items are not eligible for sanitary reasons or software corruptibility issues –
- Headrests
- Leg Extension Kits
- Speed Modification Devices
- Toilet Lifts
- Biget Seats
- Open Box or Demo Units
- Items indicated “Not Eligible for Return” on the product page.
Process:
- Contact us within 7 days of delivery to request an RMA.
- Ship the item back to us at your expense (unless due to our error).
- Upon receipt and inspection, we will process your refund.
Fees:
To cover processing and restocking costs, we charge a reasonable restocking fee of up to 30% of the product price for eligible returns (not applicable to defective items). An administrative fee of $50 may apply for handling. These fees will be deducted from your refund. Refunds are issued to the original payment method within 10 business days of approval. Please note, MarkMed Inc is not responsible for return shipping costs or lost merchandise.
We do not offer exchanges; please return and reorder if needed. For defective products, see our Warranty section below.
Note: These policies comply with applicable consumer protection laws. In states with specific return requirements (e.g., extended windows or no-fee mandates), we will honor the stricter standard.
Transparency Disclosure – Why We Charge a 30% Restocking Fee on Eligible Returns
We understand it can be frustrating when a device purchased to solve a mobility challenge doesn’t meet your expectations.
A link to this page appears on every page of www.matterofmobility.com. On the checkout page, there is also a clear acknowledgment that you have read and agree to our Terms and Conditions, located directly above the “Place Order” button for maximum visibility. We do everything we can to encourage customers to review this information before completing a purchase.
If you are reading this after the fact because you chose not to review the Terms and Conditions before buying, and the device did not work out—leaving you responsible for return shipping plus a 30% restocking fee—we want to explain why the fee exists. If you are reading this before making a purchase, thank you—we appreciate it.
Contrary to popular belief, we do not profit from returns, even with the 30% restocking fee. In fact, we lose money on every return.
We only accept returns in brand-new, clean condition that have never been used outdoors. These are the only units we can resell as Open Box. We advertise Open Box devices as “Like New Condition,” and we deliver on that promise. That is why we cannot accept returns that do not meet this standard.
You may wonder why we still charge a 30% restocking fee on a device that is in Like New Condition. The reason is time and labor.
These are medical devices. Many of our customers have immune deficiencies or other health considerations. Every eligible return must be unpacked, fully inspected (which requires removing all packaging), sanitized, and in some cases have parts replaced. The device must then be professionally repackaged, listed and sold at a reduced price, and shipped to the next customer at our expense. This process takes significant time and costs us money.
We are particular about the condition of the products we sell because people rely on medical mobility devices for their daily independence. We strive to deliver both a quality product and a good experience.
We hope this helps explain our restocking fee policy and the reasoning behind it.

Returns Without RMA Authorization
Devices returned without a valid Return Merchandise Authorization (RMA) and shipped to the return address printed on the original shipping label are not eligible for a refund or exchange.
The address shown on the original shipping label is a shared logistics facility used by multiple businesses. This facility is not equipped to receive, process, or track returns for MarkMed Inc (www.matterofmobility.com). Although a package may be signed for upon delivery, we do not take possession of unauthorized returns and have no ability to locate, identify, or retrieve the item once it arrives at the facility. Because the logistics center serves multiple companies and employs multiple staff members, we cannot track or account for packages delivered without an approved RMA.
The customer acknowledges and agrees that any item shipped to an incorrect address, including the address printed on the original shipping label without a valid RMA, is sent at the customer’s complete and total loss. It is solely the customer’s responsibility to complete the RMA form on our website within the allotted return period to determine whether the item meets the criteria for return. If the item meets the return criteria, return shipping instructions and an authorized return address will be provided. Returns sent to any other address will not be processed and will not qualify for a refund.
Condition Documentation Requirement
As a condition of any approved return, the customer must submit clear, time-stamped photographs (this is accomplished by completing the RMA Request form on our Support page) of the device before it is shipped back. These photographs serve two purposes:
- Condition Verification – We accept returns only on devices that remain in brand-new, unused condition. Because these are medical mobility devices, items showing marks, wear, soiling, or any signs of use cannot be refurbished or resold and are therefore not eligible for return or refund.
- Shipping Damage Protection – Time-stamped photographs taken prior to shipment provide documentation you may need if the device is damaged in transit. If you purchased shipping insurance, these images can be submitted to the carrier as evidence to support an insurance claim.
Failure to provide the required photographs, or returning an item that does not meet the brand-new condition standard, will result in denial of the return and forfeiture of any refund.
7. Cancellations
Orders may be canceled without charge within 24 hours of placement. After that, cancellations are subject to a 10% fee if the order has not shipped. Once shipped, cancellations are treated as returns (see above).
8. Warranties
The warranties listed on our website product pages are manufacturer warranties. MarkMed Inc does not offer warranties, however, we do, as a complementary service act as an intermediary between your item and the manufacturer. Warranty information is published on each product page individually.
Implied Warranties: EXCEPT WHERE PROHIBITED BY LAW, ALL IMPLIED WARRANTIES, INCLUDING THOSE OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THE EXPRESS WARRANTY PERIOD ABOVE. SOME STATES DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES, SO THIS LIMITATION MAY NOT APPLY TO YOU.
We do not void warranties for using third-party parts or services, unless such use directly causes the defect. This complies with the federal Magnuson-Moss Warranty Act.
9. Limitation of Liability and Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, EXCEPT AS STATED ABOVE. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR PRODUCTS, INCLUDING LOSS OF PROFITS OR DATA, EVEN IF ADVISED OF THE POSSIBILITY.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE PRODUCT IN QUESTION. SOME STATES DO NOT ALLOW LIMITATIONS ON INCIDENTAL DAMAGES, SO THIS MAY NOT APPLY TO YOU.
The Site may contain links to third-party sites; we are not responsible for their content or practices.
10. Disputes and Chargebacks
We encourage you to contact us first to resolve any issues with your order, such as billing errors or product concerns. Our team is committed to fair and prompt resolutions.
You have the right under federal law (e.g., Fair Credit Billing Act) to dispute charges with your payment provider. We will cooperate in good faith with any legitimate disputes but reserve the right to contest chargebacks we believe are unfounded.
For disputes arising from these Terms, we encourage informal resolution. If unresolved, you agree to binding arbitration in Florida under the American Arbitration Association rules, except for small claims. No class actions are permitted. This provision is enforceable under the Federal Arbitration Act.
11. Privacy
Your privacy is important to us. Please review our separate Privacy Policy, which explains how we collect, use, and protect your information. By using the Site, you consent to our privacy practices.
12. Intellectual Property
All content on the Site, including text, images, and logos, is our property or licensed to us and protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our written permission.
13. Force Majeure
We are not liable for delays or failures due to events beyond our control, such as natural disasters, pandemics, or supply chain disruptions.
14. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full effect.
